Bureau de Tabas

Tabas’ smoke shop (le bureau de tabas™) offers services, subject to the following terms and conditions, which can be changed and updated without any prior notice. Each order accepted and validated by the consumer inside the Tabas’ smoke shop (le bureau de tabas™), shall constitute and actively imply your voluntary consent to and acceptance of these general sales conditions. Thus with each such order, you thereby forever knowingly waive and relinquish any and all rights you may have to seek damages based upon any of the terms and conditions of your order and purchase. You also knowingly give up any and all rights which you may have which if known by you would have materially affected your release and relenquishment.

You further agree that you will not at any time hereafter assert any claim or commence any lawsuit against any other person or entity which shall result in third party claims being asserted against any Tabas’ Smoke Shop and agree to indemnify and hold harmless Tabas’ Smoke Shop against any claim, demand, debt, obligation, liability, cost, expense, right of action or cause of action based on, arising out of, or resulting from any such action.

The purchase of one of our products implies your acceptance of these present general sales conditions and invalidates any contradictory document, such as your own general sales conditions. This confirmation, as well as all the data that we will have collected will stand for the proof of our transaction.

1- Products
The products we distribute on the site are limited editions, and comply with French legislation in force. We strive to keep up to date available sizes and colours, but it may occur that one of our proposed products is out of stock. In such a case, you will be kept informed, and you authorize us to substitute another equivalent and available product. If you are not interested in any other products proposed on the site, you will be fully reimbursed. Tabas’ smoke shop’s (le bureau de tabas™) legal liability does not and will not extend to the rules and regulations of the destination country. The Buyer accepts full responsibility to verify and confirm the legality of importing and using our products.

2- Prices
The Price of the product varies and is dependent upon the cost of shipping and handling costs incurred based upon the final destination, whether it is in Europe or anywhere else in the world. Shipments outside of the EEOC can be subject to specific conditions and additional taxes, and are at the buyer’s expense (additional fees, authorizations).

All prices quoted are in Euros and include taxes. Any modifications of the legal rate of these taxes will be passed on to the Buyer and shown on the bureaudetabas.com site as updated. I am also not sure what this is supposed to be. What is the web site

Prices are subject to modification at any time, however, we do guarantee that we will honor the price quoted as of the date of placing your order. Prices are guaranteed until the 31st of December 2006.

3- Delivery
All Shipments are at the Buyer’s risk. Tabas’ Smoke Shop (le bureau de tabas™) can not, under any circumstances, be held responsible for deteriorations or loss of its products handled by postal services or other carriers.

Although delivery time is not guaranteed, estimates of time vary from 2 to 5 days for Europe, and 5 to 12 days for the rest of the world, after validation (approval) of your order. The Buyer acknowledges that deliveries of up to 30 days may be experienced and that Tabas’ Smoke Shop (le bureau de tabas™) shall not be liable for any damages based upon failure to deliver, nor can the order be cancelled so long as the delivery is within 30 days of the approval of your order. Tabas’ Smoke Shop (le bureau de tabas™) can not engage itself on any delivery date, out of the French territory and the maximum damages that the Buyer is entitled to as a result of a failed delivery which is the fault of Tabas’ shall be the refund of the monies paid..

The Buyer is responsible for inspection of all delivered packages and shall be responsible for the filing of any claims for loss or damage to the postal service or delivery company. In the case of damaged merchandise, the Buyer shall be responsible for making any claim made directly to postal services or delivery company.

4- Exchange or reimbursement
An article can be exchanged or reimbursed if it is sent back intact and within 15 days of receipt ( according disposition L121.16 of the French consummation code) and it is in mint condition, in its original packaging, including its invoice code. In case of a reimbursement, only the price of the product will be reimbursed, and it may be done by visa card or check, directly on the buyer’s bank account, and according to his or her invoice address. In case of an exchange, sending and returning costs will be at the buyer’s expanse. If you return a product because of a mistake made by our services, your shipping and handling fees will be fully reimbursed.

5- Payment
Online credit card payment available via Paypal® (requires a valid credit card number and validity date). All orders, whatever their origin, are to be paid in Euros. Our shop's security is our foremost priority. This is why we use the Paypal® payment system, with its unrivalled expertise in secured online payment. Paypal ensures the security of your transactions on several levels:

Encryption of outgoing data: Thanks to the SSL protocol (Secure Sockets Layer), your credit card information is encrypted on your own computer before being sent to the Paypal server.

No storage of confidential data: information regarding your credit card (name, type of card, number and validity date) are sent directly to Paypal. Their system first checks the validity of your data using the appropriate payment network (VISA and such), then accordingly validates the transaction without retaining any kind of confidential information. Under no circumstance do we acquire any secured information, nor do we record them.

In agreement with the CNIL's legal dispositions (art. 34, Informatique et Liberté Act, jan. 6th 1978 ), le Bureau de Tabas™ will not seek to leak, sell or exploit personal data.

6-Responsibility
Tabas’ Smoke Shop shall not be held responsible for any misuse of the ordered articles, or their content. Proposed products respect the French legislation. Tabas’ Smoke Shop (bureau de tabas.com) boutique can not be held responsible for not applying to the laws in force in any country of its products destination. (Censorship, illegalness of a title, an author).

Characteristics of our products may be modified or improved at any time and without notice. Texts and pictures present on the online boutique that illustrate the merchandise are not transferred by Tabas’ to the Buyer.

7- Copyright
The texts, comments, work, illustrations and images contained in the online boutique are the sole property of Tabas™ and are protected by the author’s copyrights wherever they may be , worldwide. The use of any materials are only authorized by the written permission of the author and are not otherwise permitted. In the absence of any prior written authorisation sent by Tabas™, any other use of the copyrighted material will be considered as a counterfeit and sanctioned by the code of intellectual property.

8- Applied Law
These sales general conditions are under French law.

For any reclamation (complaint), contact us. In case of a dispute, Marseilles jurisdiction will be the only one competent.
